12) Governing Law

FOR TRAILER RENTAL

1A) Acceptance of trailer. You shall inspect the trailer before it is delivered to you. You shall immediately in writing notify us prior to accepting delivery of the trailer of any discrepancies between such item and the description of the trailer in the Listing Description. If you fail to provide such notice before accepting delivery of the trailer, you will be conclusively presumed to have accepted the trailer as specified in the Listing Description.

1B) Refund Policy. Refunds of deposits for cancellation of this rental agreement 100% for cancellations 48 hours prior to scheduled delivery of the trailer, 50% for cancellations 48 hours prior to scheduled delivery of the trailer and 0% for cancellations 48 hours prior to scheduled delivery of the trailer.

2) Credit Card Use. We may provide your name, address, credit card and/or debit card information, and all other necessary information to any third party to enable collection of or transfer liability for such amounts, and we may do so without additional notice to you. Before and after your rental term, we may maintain your credit card or debit card information as a means of payment, deposit or security, and we, or a third party may submit all amounts owed for the trailer rental for payment on such card(s), including if any third party to whom a billing was directed refuses to make payment. If we initiate any charge that is dishonored, we may re-initiate the charge without your further authorization.

3) Security Deposit. At the time that this rental agreement is signed, we may, in lieu of collection of a security deposit, place a hold on a credit card in the total rental amount. Any amounts refundable to you shall be paid or released from the credit card hold within five (5) days after this rental agreement is terminated, subject to our option to apply repayments against additional charges, damages and the security deposit.
